ARC 2013 PET “PIN-UP” PHOTO CALENDAR CONTEST

OFFICIAL RULES

ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. Eligibility. Subject to the additional restrictions below, ARC’s Pet Photo Calendar Contest (the “Contest”) is open to U.S. residents (excluding Puerto Rico), 18 years or older at the time of entry. Employees and Board Members of the Animal Refuge Center (“ARC”), and their immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. Previous winners may enter but must utilize a different photo of their pet.

2. Contest Period: Contest begins at 12:01 a.m. (E.D.T) on May 14, 2012 and ends at 11:59 p.m. (E.D.T.) July 31, 2012.

3. How to Enter. Beginning at 12:01 a.m. (E.D.T.) on May 14, 2012 and ending at 11:59 p.m. (E.D.T.) on June 30, 2012, enter by submitting a photo of your pet to the email address provided on the “Calendar” tab on the Animal Refuge Center’s website along with all required information and $5 entry fee. Photos must be submitted by an adult 18 years or older. ARC reserves the right to verify proof of age. Pet owner’s name, phone number and valid email address must be included with all entries. Entries with incomplete or incorrect information will not be accepted. Only photos of a dog or cat that you own are eligible to win the contest and appear in ARC’s 2013 Pet Pin-Up Photo Calendar. You may enter multiple times but for different pets. Only one photo per entry per pet.

Only digital photos submitted online will be accepted. The photo should be in JPEG format, no larger than 1MB in size and sent to the email address provided. Most digital pictures taken in the mid-to-high quality camera setting will be fine. The cropping of pictures may be done as needed. Poor quality photos of either type will not be accepted. Once you have submitted your photo, click the button on the calendar web page that says “Pay Entry Fee”.   Photos will not be posted until information is verified, entry fee payment is received and/or the photo is approved by a website administrator. Submitting this information, the photo and an entry form serves as a release for ARC and Sandbar Photography to contact you, use your pet’s first name and photo in marketing materials associated with ARC, the 2013 Pet Pin-Up Photo Calendar, on ARC’s website (animalrefugecenter.com) and social media sites. By entering, you agree to the terms of these Official Rules and to receive e-mails from ARC. You can opt-out of the receipt of such e-mails by following the directions on the contest website or in any email received from ARC. Donations can be remitted online, in cash, by check, money order or credit card. Photos will not be deemed submitted for entry until payment is received in full. You may pay for your entry fee online or send a check or money order as payment, made payable to ARC (Animal Refuge Center). Payments must be received no later than 11:59 p.m. (E.D.T.) on June 30, 2011. Send check/money order payments to: ARC, P.O. Box 6642, Fort Myers, FL 33911. All photos become property of ARC and will not be returned. Copyrighted photos and non-digital photos will not be accepted. 4. Voting Procedures and Rules. The voting period will begin at 12:01 a.m. (E.D.T.) July 1, 2012 and conclude at 11:59 p.m. (E.D.T) July 31, 2012. Vote for your favorite pet by submitting a vote through the contest website. Only online votes will be accepted. Updated voting totals will be posted online during the voting period. Multiple votes from one or more ISP accounts by means of software generated or other automated processes will be disregarded. Voting is open to the general public. Online voting is limited to persons 13 years of age or older. You may vote on one photo one time per day.

5. Winner Selection. Winners will be determined by total votes only. In the event of a tie, ARC will randomly pick the winner from the tied entries. The pet receiving the highest number of votes will be the Grand Prize Winner. The next top 5 cats and the next top 5 dogs receiving the highest votes will be winners to be featured on the ARC 2012 Pet “Pin-Up” Photo Calendar. Winners will be selected on or about August 1, 2012.

6. Prizes and Odds. First Place Prize: One (1) First Prize Winner will be featured on the cover and on one month of their choice within the ARC 2012 Pet “Pin-Up” Calendar. They will receive a free photo session with Sand Bar Photography, valued at $150. Winner must be available for all photo sessions taken by ARC and/or the Sand Bar photographer at Sand Bar’s photo studio location. Winner will be featured on the ARC website and social media sites, as well as any additional promotional materials. Additional prizes provided by ARC as listed on the contest website will be awarded. ARC reserves the right to determine winners in the event of disqualification of entrants. The animal that appeared in the submitted photo must be the animal that appears in the photo shoot for the calendar.

*The remaining top 11 prize winners will be also featured in the ARC 2013 Pet “Pin-Up” Calendar. They will receive a free photo session with Sand Bar Photography. Winner must be available for all photo sessions taken by ARC and/or the Sand Bar photographer at Sand Bar’s photo studio location. Winner will be featured on the ARC website, social media sites as well as any additional promotional materials. Additional prizes provided by the sponsors as listed on the contest website will be awarded. The animal that appeared in the submitted photo must be the animal that appears in the photo shoot for the calendar. All winners must be available August 1, 2012 through August 30, 2012, for photos or risk not receiving these prizes.

Odds of winning depend on the number of eligible votes received.

7. Winner Notification and Acceptance. Winners will be notified on or about August 1, 2012, via the email address provided on the winner’s entry form. If winners are notified by telephone, ARC will call at number(s) provided on entry form and will leave no messages. Failure to reach winner and obtain a response via email or by phone by August 5, 2012 may result in disqualification of winner, forfeiture of his or her interests in all prizes, and selection of a substitute winner from among all remaining eligible entries. Winners will be announced on the contest website as well as http://www.animalrefugecenter.com on or about August 1, 2012. To claim a prize, winners must be available on the date specified by the photographers and ARC, for photos to be taken or risk not receiving prizes. All winning pet owners specifically grant the right to ARC and Sand Bar Photography to publish the photos of their pets in media outlets. Winners may waive their right to receive prizes. Prizes are non-assignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and ARC reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. You must be 18 to win. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation to the Internet or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of ARC. 8. Participation. By participating, entrants agree to pay the $5 entry fee and be bound by these Official Rules and the decisions of ARC. ARC reserves the right to disqualify persons failing to pay entry fee and/or who are found tampering with or otherwise abusing any aspect of this contest as solely determined by ARC. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of ARC which corrupts or impairs the administration, security, fairness or proper operation of the contest, ARC reserves the right in its sole discretion to suspend, modify or terminate the contest. Should the contest be terminated prior to the final date, ARC reserves the right to award prizes based on the ballots received before the termination date.

9. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

10. Sponsor. The 2013 “Pet Pin-Up” Photo Contest is sponsored by the Animal Refuge Center, Inc. for the benefit of ARC. The Contest is administered by ARC. The decisions of ARC regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. ARC will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest. Deuce has a lot of puppy energy.  He loves to go for walks, loves to go for runs and he will let you know he is in the room and demands attention.  Deuce needs puppy manners but he would be happy in a house with adults and children.
